The Wayne County Prosecutor's Office hasn't given up hope of trying to prosecute Detroit Tigers minor league pitcher Evan Reed on sexual assault charges.

In August, Detroit 36th District Judge Kenneth King dismissed two, third-degree criminal sexual assault charges against Reed, saying his accuser, a 45-year-old woman, wasn't credible. King said it also was never proven that she she was incapacitated.  The encounter happened in March at the Motor City Casino.

At the time Reed, 28, was thrilled with the judge's ruling, telling reporters: “I’m just extremely happy. I  can have all my focus on baseball again.”

But Prosecutor Kym Worthy's office decided in September to quietly appeal that the dismissal in Wayne County Circuit Court.

On Friday at 9 a.m., a hearing on the appeal will be  held before Judge Michael Callahan.

Maria Miller, a spokeswoman for the Wayne County Prosecutor's Office, said Tuesday:

"We’ll wait to see how the court rules before we comment on the case."

Reed's attorney Ben Gonek said:

"This appeal is truly a waste of taxpayer dollars. It is time for the Wayne County Prosecutor’s Office to put closure to this and concentrate on prosecuting real crime."
