Condo Owner with Cancer Sues Over Neighbor's Secondhand Smoke

Phyllis Davis, a Farmington Hills woman recovering from breast cancer and battling asthma, is suing because her neighbor's second hand smoke is making her sick. She says she's having a hard time breathing.

"At the end of the day, all she wants is to breathe in her home comfortably," attorney Alan Gocha tells Erika Erickson of Fox 2. "It seems that no one seems to care what's happened to her because it doesn't affect them."

Davis filed a lawsuit last week against Echo Valley Condominium Association, its property management company Casa Bella and the two owners of unit 115 their client. 

Davis, who bought her condo in 2014, says her neighbors in a connected unit, who rent,  smoke cigarettes and other substances incessantly. She is exposed to the smoke through a shared ventilation system.

Gocha says that is a violation of the Federal Fair Housing Act and that the neighbors need to smoke outside of the apartment.
