Deadline Detroit Bernstein Service Award Rules And Regulations

  1. ENTRY TO CONTEST:
    To enter the “Deadline Detroit Bernstein Service Award” Contest (“Contest”) an organization must be nominated for the award. Nominations may be submitted on the form available on Deadline Detroit, Inc.’s website, http://www.deadlinedetroit.com/ between 12:01 a.m. EST on February 5, 2014 and 5:00 p.m. EST on February 19, 2014 ("Nomination Period"). A nomination submitted before or after the nomination period will not be considered. An individual may not submit more than one nomination.
     
  2. ADDITIONAL ENTRY REQUIREMENTS:
    Only non-profit charitable organizations with tax-exempt status, as defined by the IRS Code 26 U.S.C. § 501(c) (3) are eligible to participate in the Contest. Each nominated organization will be asked for written confirmation that it has tax-exempt status, that it wants to enter the Contest, and that it agrees to all the terms and conditions of these Official Contest Rules. An organization must submit this written confirmation by 5:00pm EST on February 22th, 2014 to participate in the Contest.
     
  3. In addition, a nominated organization must also represent and warrant that it has the authority to grant the permission and rights granted herein, that no other permission is required to grant such rights, and that the organization irrevocably grants The Sam Bernstein Law Firm, PLLC and Deadline Detroit, Inc. (“Promotion Entities”) the right, but not the obligation, to use the organization’s name, likeness, and address (city, state and zip code) (collectively “Attributes”) for advertising and promotional purposes in any and all media, now known or hereafter devised (including without limitation by telecast and on websites), without notice, review, or approval, in perpetuity and throughout the universe without further compensation, and that the organization releases the Promotion Entities and their respective parents, subsidiaries and affiliated companies, advertising and promotion agencies, and all of their respective owners, officers, directors, employees, representatives, and agents from all claims arising out of any such use. Promotion Entities are not responsible for lost, late, damaged, misdirected, illegible, or incomplete entries.
     
  4. ELIGIBILITY:
    All Federal, State, and local laws and regulation apply. No purchase is necessary to enter or win. Void where prohibited by law. Organizations with principle members who are employed by The Sam Bernstein Law Firm, PLLC or Deadline Detroit, Inc. and its respective parent companies, sales representatives, distributors, subsidiaries, affiliates, related companies, or advertising and promotion agencies, and the immediate families and/or household members of each of the above are not eligible to enter.
     
  5. SELECTION:
    A panel of judges from The Sam Bernstein Law Firm, PLLC and Deadline Detroit, Inc. will select up to FIVE organizations from the eligible nominees for the voting portion of the Contest. After selection, these organizations will be featured on The Sam Bernstein Law Firm, PLLC’s Facebook page, www.facebook.com/CallSam (“The Call Sam Facebook Page”) beginning on March 3, 2014. Any Facebook users who “LIKE” The Call Sam Facebook Page may vote for the organization of their choice, through a voting app on that Facebook page. Voting will end at 5:00 p.m. EDT on March 30, 2014. Votes cast after that time will not be counted. Votes will be tallied after the voting period ends. Only one vote per person is permitted.
     
  6. NOTIFICATION:
    The designated contact person for each organization that participated in the voting portion of the Contest will be notified by telephone or email of the voting results and any prize awards by March 31, 2014.
     
  7. PRIZES:
    Organizations that participate in the voting portion of the Contest will be awarded a prize equal to $0.25 per vote received during the voting period, up to a maximum prize of $5,000.00 per organization. The organization that receives the most votes will receive an additional $500.00. Federal, State, and local taxes on Prizes are sole responsibility of the Prize Winners, which may be issued a 1099 IRS tax form. Prize Winners are advised to seek independent counsel regarding Prize Winnings.
     
  8. PRIZE ACCEPTANCE:
    Each Prize Winner will be required to complete, signed, have notarized, and return an Affidavit of Eligibility/Prize Acceptance/Liability and Publicity Release Form (except where prohibited by law) within 5 days of notification, or Prize will be forfeited. Individuals publicly associated with the promotion of a Prize Winner may be required to complete, signed, have notarized, and return an Affidavit of Eligibility/Prize Acceptance/Liability and Publicity Release Form (except where prohibited by law) following notification and receipt. A Prize Winner must consent to use of its name and likeness for advertising purposes worldwide, without limitation and without additional compensation, except where prohibited by law and must also agree to release both The Sam Bernstein Law Firm, PLLC and Deadline Detroit, Inc. and their respective parents, subsidiaries, affiliates, distributors, and related companies and their respective owners, officers, directors, employees, and agents from all liability, loss or damage of any kind arising out of or in connection with the participation of the Prize Winner in this Contest, or with respect to awarding, receipt, possession, use and/or misuse of any Prize or participation in prize-related activities. If an organization does not return the Affidavit(s) of Eligibility and Release(s) by the deadline date, or if the organization has not otherwise complied with these Official Rules, the panel of judges may select an alternate winner or withhold prizes. All decisions of the judges shall be final.
     
  9. SPONSOR:
    The Contest Sponsor is The Sam Bernstein Law Firm, PLLC, 31731 Northwestern Highway, Suite 333, Farmington Hills, Michigan 48334 (“Sponsor”)
     
  10. GENERAL:
    The Contest is subject to all applicable Federal, State, and Local laws and regulations. By agreeing to participate in this Contest and/or accepting prizes, entrants and Prize Winners agree to be bound by these rules and the decisions of the Sponsors, and waive any right to claim ambiguity in the Contest or these Official Rules. Any person attempting to defraud or tamper with the Contest will be prosecuted. Any organization associated with vote-manipulating behavior shall be disqualified immediately from the Contest and be ineligible to receive and prizes. This determination is in the sole discretion of The Sam Bernstein Law Firm, PLLC. All voters on Facebook must comply with the terms and conditions associated with using, and holding an account, on Facebook.com. “Liking” The Call Sam Facebook page is necessary to enable the user to “connect” to that page to cast a vote in this Contest.  “Liking” is not, and should not be construed as, the user’s opinion or a recommendation of The Sam Bernstein Law Firm, PLLC or its legal services.  When a user votes in this contest, he/she consents to the privacy policy associated with this Facebook application.  That policy can be found at www.shortstack.com/privacy/.
     
  11. WINNER’S LIST:
    For the results of the voting in the Contest, which will be available after April 7, 2014, send a self-addressed stamped envelope, to be received no later than April 15, 2014, to The Sam Bernstein Law Firm, PLLC, 31731 Northwestern Highway, Suite 333, Farmington Hills, Michigan, 48334, Attention: Deadline Detroit Bernstein Service Award.
