Macomb Jury Deadlocks in Case of Fatal Punch at St. Clair Shores Bar

A Macomb County jury deadlocked Thursday in the trial of a 36-year-old man charged with throwing a fatal punch outside Kapones Sports Tavern on Harper Avenue in St. Clair Shores in May 2018.

Jurors deliberated for about two days before the judge declared they were hopelessly deadlocked on the manslaughter charge, The Macomb Daily reports. A mistrial was declared and a new trial is set for Feb. 1. 

Andrew Werling is charged with punching Eric Hysell, 56, in the head outside the rear door of the bar. Hysell died three days later. Werling claimed self defense, saying he was protecting himself and bar patron Mark Foster. 

Werling’s attorney, Craig Tank, tells the paper the the jury was evenly split 6-6 or slightly in favor of conviction at 7-5.

Werling was a handyman for the strip mall where the bar is located and had an office there, according to the suburban daily.
